Terms of service

mirok.ai is a service published by GAMATHEL (a French SAS with share capital of €500, Paris Trade and Companies Register 940 515 877, registered office at 60 rue François 1er, 75008 Paris) that provides an AI-powered marketing agent able to coordinate specialized agents (SEO, GEO, writing, social media, etc.) to analyze a website and produce marketing recommendations and content.

Creating an account and/or using the Service constitutes full and unreserved acceptance of these Terms. If you do not accept these Terms, you must not use the Service.

"Service" means the mirok.ai platform as a whole (website, cockpit, API, free tools); "User" means any person creating an account; "Organization" means the workspace one or more Users belong to; "Credits" means the unit measuring consumption of the Service, debited for each action an agent performs; "Generated Content" means any text, draft, recommendation, metadata, or visual produced by a Service agent.

Access to the Service requires creating an account with a valid email address. The User warrants the accuracy of the information provided and undertakes to keep it up to date.

Registration is reserved for adults or persons duly authorized to contract on behalf of a business. A free trial, with no commitment or credit card required, is available to try the Service before any paid subscription.

The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their account.

Each action performed by an agent (audit, drafting, publishing) consumes a number of Credits, determined and displayed before confirmation. In "copilot" mode (the default), every output waits for the User's explicit approval before publication; in "automatic" mode, the User authorizes execution and publication without prior individual review.

Generated Content is produced by artificial intelligence models and may contain inaccuracies, approximations, or errors. GAMATHEL does not guarantee the accuracy, completeness, or commercial relevance of Generated Content.

It is the User's responsibility to review, verify, and approve any Generated Content before any publication or public distribution, including in automatic mode, where this review must be performed upstream via the agent's configuration. The User remains solely responsible for the content they publish, regardless of how it was produced.

The User agrees to use the Service in accordance with the law and these Terms, and in particular not to:

• publish, via the Service, unlawful, defamatory, infringing content or content violating third-party rights;
• attempt to circumvent the Service's technical limits (quotas, caps, anti-abuse measures) or automate a use not contemplated by these Terms;
• compromise the security or integrity of the Service, or extract data from it without authorization;
• use the Service for fraudulent, deceptive, or unfair-competitive purposes.

The Service allows connecting third-party tools (CMS, social networks, analytics tools) through authorizations the User grants and can revoke at any time from settings. GAMATHEL is not responsible for the operation of these third-party services, which are governed by their own terms.

GAMATHEL retains all intellectual property rights attached to the Service (software, interface, trademarks, methods). Nothing in these Terms transfers any right in these elements to the User.

Subject to compliance with these Terms and payment of amounts due, the User holds exploitation rights over the Generated Content produced specifically for their own website, for commercial and non-commercial purposes.

GAMATHEL strives to ensure continuous access to the Service, without guaranteeing absolute availability. Interruptions may occur for maintenance, updates, or force majeure.

GAMATHEL reserves the right to evolve, add, or remove Service features, subject to informing affected Users when this substantially affects an ongoing paid plan.

The Service is provided "as is." GAMATHEL does not guarantee that the Service, or the Generated Content, specifically meets the User's business objectives (traffic, conversions, ranking).

To the extent permitted by law, GAMATHEL's liability under these Terms is limited to direct damages and shall not exceed the amounts actually paid by the User over the preceding twelve months. GAMATHEL shall not be liable for indirect damages (loss of revenue, reputation, or data).

GAMATHEL may suspend or terminate a User's access in the event of a serious breach of these Terms, in particular fraudulent or unlawful use, or use compromising the Service's security, following notice where circumstances allow.

The User may terminate their account at any time from settings; termination of a paid subscription is governed by the Terms of sale.

These Terms are governed by French law. In the event of a dispute, the User may first contact GAMATHEL at [email protected] to seek an amicable solution.

Under articles L. 616-1 et seq. of the French Consumer Code, any consumer is entitled to use a consumer mediator free of charge to seek an amicable resolution of a dispute. Failing an amicable agreement, the competent French courts shall have sole jurisdiction, subject to mandatory rules applicable to consumers.
