Terms of sale

These Terms of Sale govern the sale, by GAMATHEL (a French SAS with share capital of €500, Paris Trade and Companies Register 940 515 877, registered office at 60 rue François 1er, 75008 Paris), of paid subscriptions to the mirok.ai service, as well as, where applicable, one-off Credit top-ups.

The available plans (currently "Growth" and "Scale"), their content (included agents, quotas, features), and current pricing are presented on the mirok.ai/pricing page, in euros exclusive of applicable taxes. A free trial, limited in features and with no purchase obligation, is offered before any paid subscription.

Prices are those in effect at the time of subscription or renewal. GAMATHEL reserves the right to change its pricing; any change has no effect on an already-paid period and applies at the next renewal, after prior notice to the customer.

Subscribing to a paid plan requires an active account and payment by card via Stripe, a payment provider that collects and processes the customer's banking data directly; GAMATHEL never has access to this data.

For business customers, the intra-Community VAT number and billing address are collected at subscription. For individual customers, only the information necessary for simplified invoicing is requested.

Payment is due immediately upon subscription, then at each renewal due date (monthly or annual, depending on the chosen cycle).

The subscription is entered into for the chosen term (monthly or annual) and automatically renews for an identical term, unless terminated by the customer before the renewal date.

The customer may terminate their subscription at any time from their account's billing settings; termination takes effect at the end of the already-paid period, with no pro-rata refund unless otherwise required by law.

Under article L. 221-18 of the French Consumer Code, any individual (non-business) customer has 14 days from subscription to exercise their right of withdrawal, without having to justify their decision or bear costs other than those provided by law.

However, under article L. 221-28 of the French Consumer Code, this right cannot be exercised for the supply of digital content not supplied on a physical medium whose performance has begun after the consumer's prior express agreement and express waiver of their right of withdrawal. At subscription, individual customers are asked to explicitly tick a waiver box if they wish for immediate access to the Service; otherwise, access to paid features is only activated once the withdrawal period has expired.

An invoice is issued for each payment and made available to the customer from their billing area. For business customers, the invoice states the intra-Community VAT number provided at subscription.

Persons recommending mirok.ai through the affiliate program are subject to the General terms of the affiliate program, distinct from these Terms of Sale.

GAMATHEL's liability under these Terms of Sale is limited as set out in the "Liability" section of the Terms of service.

These Terms of Sale are governed by French law. Under articles L. 616-1 et seq. of the French Consumer Code, any individual customer is entitled to use a consumer mediator free of charge. Failing an amicable agreement, the competent French courts shall have sole jurisdiction, subject to mandatory rules applicable to consumers.
